1. About these terms
These Terms and Conditions govern use of perpetualimpact.org and the website materials made available by Perpetual Impact ("we", "us" or "our"). They cover browsing, accessing documents and using the illustrative calculator. Questions about these terms or the responsible website operator should be directed to privacy@perpetualimpact.org.
By using the website, you agree to these terms to the extent an enforceable agreement is formed under applicable law. If you do not agree, do not use the website. Nothing here excludes mandatory legal rights or makes mere browsing an agreement to donate, invest, lease property or apply for benefits.
Separate signed or expressly accepted agreements govern any future donation, investment, housing placement, nonprofit lease or other service. Those agreements take priority for their subject matter. This website does not create those agreements or replace final transaction documentation.
2. Eligibility and your responsibilities
The website is directed to adults seeking information about the program. You must have legal capacity to enter any separate transaction. If acting for an organization or another person, you must have authority to do so. Viewing a page does not establish that you qualify for an investment or assistance program.
You are responsible for using the website lawfully, keeping your own device secure, checking information relevant to your circumstances and ensuring any information you send is accurate to the best of your knowledge. Do not impersonate another person or submit information you have no authority to disclose.
3. Website and program status
The website describes a real-estate-backed model intended to support transitional housing, food assistance and SNAP guidance. Some services and program arrangements are proposed or under development. The current website is informational: it does not accept online payments, execute investment subscriptions, create visitor accounts or submit SNAP applications.
Property photographs identified as illustrative are not proof of portfolio ownership, property availability or operational results. References to possible partners or delivery approaches do not establish an endorsement, signed partnership or government affiliation.
Website access is normally free, but your internet or device provider may charge you. Access may be interrupted for maintenance, security, technical failures or circumstances outside our control. We may update, restrict or discontinue website features, subject to any separate contractual commitments and mandatory law.
4. Information only; no professional advice
Website content and documents are general information for discussion. They are not individualized financial, investment, legal, tax, property, welfare-benefit or other professional advice. They do not assess your objectives, resources, risk tolerance, eligibility or personal circumstances.
Obtain independent advice from appropriately qualified advisers before donating significant funds, investing or entering a transaction. Verify property, licensing, occupancy, tax and regulatory matters independently. Neither reading the website nor corresponding with us creates an adviser-client, fiduciary, agency or professional-services relationship.
5. Investment information and financial risks
No website statement is itself an offer, solicitation, recommendation or commitment to issue a security or accept an investment. Any lawful offering would require the relevant issuer's final documents, applicable eligibility checks and compliance with securities laws in the relevant jurisdiction. The website does not state that any offering has regulatory approval.
The proposed 6% annual return, $10,000 minimum, 25-year term, withdrawal breaks, first-priority lien and investment-to-value policy are discussion assumptions, not enforceable promises made by these terms. Availability, fees, ranking, repayment, withdrawal procedures and security depend on final documentation. A lien or equity cushion does not guarantee recovery.
Investments involve risk, including loss of some or all capital, delayed or missed payments and limited liquidity. Relevant risks include acquisition and renovation costs, property valuations, vacancies, tenant or nonprofit default, insurance, maintenance, regulation, taxation, management, economic conditions and the enforceability of security. Capital may be tied up for a substantial period.
Property gross cash yield is not the investor's return. Projections are not operating results. Past results, if later provided, would not guarantee future performance. No website statement guarantees principal repayment, interest or an exit opportunity.
6. Illustrations, assumptions and calculator results
The calculator applies a simple 6% annual rate to the amount entered and multiplies annual income by five for a five-year illustration. It does not compound returns or account for taxes, fees, missed payments, inflation, exchange rates or principal repayment. Five years is an illustration, not a promised maturity or redemption date.
Property scenarios use assumed acquisition and renovation costs, rent, business costs and allocation figures. These assumptions may change and may not hold for a particular property. Website scenarios and source documents may differ; examine the original materials and ask about discrepancies rather than treating a summarized figure as a contractual term.
Calculator output and other estimates must not be relied on as a guarantee, valuation, suitability assessment or binding quotation. We seek to correct material errors when identified, but do not promise that all content is complete, current or free of errors.
7. Donation descriptions and charitable status
A donation and an investment are different. A donation description does not promise an investor return, ownership interest or right to withdraw funds. An investment description does not make a contribution charitable or tax-deductible.
Before making any contribution, obtain the recipient's legal identity, relevant charitable or nonprofit status, payment instructions, intended use of funds, any restrictions and the applicable refund arrangements. The website alone is not proof of registered charitable status, tax exemption or donation deductibility in any country. Consult a tax adviser about your circumstances.
The current website does not process donations and these terms do not establish a refund policy for a future payment service. Any future donation process must disclose its terms before payment, including payment-provider conditions, receipts, restricted-gift arrangements and how errors or refund requests are handled. We do not authorize payment through unsolicited or unverified instructions.
8. Social impact, housing and food assistance
Descriptions such as "support forever", "perpetual" and "in perpetuity" express the program's intended long-term model, not an unconditional guarantee of indefinite funding or continuous service. Ongoing assistance depends on productive properties, operating income, costs, available partners, legal requirements and financial sustainability.
Housing places, meals, families supported and food-assistance allocations are targets or illustrative measures unless clearly identified as verified results. Browsing, donating or investing does not guarantee a particular housing placement, food allocation, number of beneficiaries or outcome.
Housing and food support may be delivered by independent operators under their own eligibility, safeguarding and service rules. Placement depends on availability and applicable requirements. This website is not an emergency housing, medical or crisis-response service; for an emergency, contact the appropriate local emergency or assistance service.
9. SNAP guidance and government benefits
The SNAP guidance service described on this website is a proposed service, not an operational application submission tool on this site. Perpetual Impact is not a government agency and does not determine SNAP eligibility, issue benefits or guarantee approval, benefit amounts or processing times.
Any future guidance would be informational support, not legal representation or an official eligibility determination. Requirements vary by state and can change. Verify deadlines, evidence requirements and current rules with your state benefits agency or an authorized adviser. You remain responsible for reviewing any application and ensuring its accuracy and timely submission unless a separate agreement expressly provides otherwise.
Do not send benefit applications, Social Security numbers or sensitive household records to the privacy email address. An authorized service, if introduced, will need separate privacy information and an appropriate submission process.
10. Documents and confidentiality
The source investor materials are marked "Confidential — for discussion purposes only" and are made accessible on this website at the document owner's request. Public access does not remove the documents' qualifications or grant permission to reproduce or distribute them beyond an authorized use.
You may read materials to evaluate the program and make copies reasonably necessary for that personal evaluation, subject to applicable law and any additional restriction notified with a document. Obtain permission before commercial republication, redistribution or presenting the materials as your own. Preserve copyright notices, disclaimers and context.
If you enter a separate confidentiality agreement, that agreement remains applicable. Where disclosure is legally required, nothing in these website terms prevents complying with that requirement. Downloaded documents may become outdated; check the date and request current materials before a decision.
11. Intellectual property and permitted use
Website text, layouts, branding, images and materials are owned by Perpetual Impact or used under the rights of their respective owners, except where otherwise stated. Access grants a limited, non-exclusive permission to use the website for lawful personal or internal informational purposes; it does not transfer ownership.
Do not remove ownership notices, falsely claim affiliation, use our name or logo to imply endorsement, or exploit materials commercially without permission. This does not restrict lawful quotation, fair use, accessibility rights or other exceptions that cannot be excluded by contract.
Third-party names and marks belong to their owners. Their appearance does not necessarily signify sponsorship, partnership or endorsement.
12. Prohibited conduct
You must not:
- Use the website for fraud, unlawful solicitation, harassment or infringement of another person's rights.
- Attempt unauthorized access, bypass security controls or interfere with normal operation.
- Upload or transmit malicious code, exploit a vulnerability or subject the site to excessive automated requests.
- Harvest personal information or use the site to send unsolicited communications.
- Misrepresent a calculator result, illustration or proposed term as a guaranteed offer.
- Reproduce materials in a way that strips out material risk warnings or creates a misleading impression.
Ordinary search indexing and lawful accessibility tools are not prohibited merely because they are automated. If you identify a vulnerability, contact privacy@perpetualimpact.org without accessing other people's data or disrupting the service.
13. External links and third-party services
External fonts, hosted PDFs and links may be provided through independent services. We do not control their availability, security, content or terms and do not endorse every statement on a linked website. Review their own terms and privacy notices before providing information or using their services.
Links may change or become unavailable. Your dealings with independent operators, advisers, charities, government agencies and other third parties are subject to the relevant separate arrangements. Nothing here excludes responsibility that applicable law requires us to retain.
14. Privacy and communications
Our Privacy Policy explains the handling of website information and enquiries. Do not send unnecessary sensitive information or confidential third-party records. Email may not be a secure channel for such information.
Sending an enquiry does not bind us to accept a donation or investment, provide assistance or enter a transaction. Any commitments must be made through an authorized process. For legal and privacy matters, contact privacy@perpetualimpact.org.
15. Disclaimers and limits of responsibility
To the extent permitted by law, the informational website and materials are provided on an "as is" and "as available" basis, without a guarantee of uninterrupted access, complete accuracy, fitness for a particular purpose or freedom from harmful technical conditions. You should independently verify information before relying on it.
To the extent permitted by law, we are not responsible for indirect or consequential losses, loss of anticipated profits or opportunities arising from use of the informational website or reliance on illustrative projections. This does not change the obligations of an issuer, recipient or service provider under a separate transaction agreement or applicable law.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such exclusion is prohibited, or any liability or consumer, investor, privacy or other right that cannot lawfully be excluded or limited. If a limitation is not permitted in your jurisdiction, it applies only to the extent allowed. These terms do not require you to waive statutory remedies.
16. Changes, suspension and ending use
We may revise website materials and these terms. The version published here will state its last-updated date. Changes apply prospectively to website use, subject to applicable notice and acceptance requirements; they do not retrospectively alter a signed investment, donation or service agreement.
We may restrict access where reasonably necessary to address unlawful use, a security threat or operational risk. You may stop using the website at any time. Ending website access does not end a separate contract or extinguish rights or obligations that should continue by their nature.
17. Complaints, applicable law and disputes
Please first raise website concerns with privacy@perpetualimpact.org, describing the issue and the outcome sought. We will seek to address the matter fairly. This informal process does not prevent you from using any regulator, court or complaint mechanism available under applicable law.
Applicable law and the courts entitled to hear a website dispute are determined by the relevant conflict-of-laws and jurisdiction rules, including mandatory protections applicable to you. These website terms do not select an exclusive foreign court or require arbitration, and do not waive class-action rights or statutory protections.
Any future investment, donation or service agreement may contain its own lawful governing-law and dispute provisions. References to Chicago properties do not, by themselves, establish the website operator's legal domicile or an exclusive jurisdiction for all visitors.
18. General provisions and contact
If a provision is found unenforceable, the remaining provisions continue to the extent permitted by law. A delay in enforcing a right is not automatically a waiver. These terms do not establish a partnership, employment relationship or agency between you and Perpetual Impact.
These terms govern the informational website only and do not supersede a separate transaction agreement. No third-party contractual rights are created except where mandatory law provides otherwise.
For questions, permissions, complaints or notices concerning these Terms and Conditions, contact Perpetual Impact at privacy@perpetualimpact.org.
